Act 209 the State Law that created West End anAd MYHMC does not allow any funds from the MYHMC Lands to ever transfer to the City. For more than a Century the State Law mandates MYHMC(The remaining Act 209 Lands) to be a self funding independent commercial real estate development. Today by City Ordinance all the lands and revenues are dedicated to the boats and marine industry.

Any rate increases or new tenant revenue must go the boats, slips, and local marine industry. Sales Taxes or Property Taxes would be different.

Each delay in the leasing of the western parcels will require larger rent increases on the slip tenants. The entire MYHMC Business Case is dependent on significant new commercial revenues from the parcels west of West Roadway/Breakwater. The Remaining Act 209 Lands MUST be self sustaining.

"The New Orleans Municipal Yacht Harbor Management Corporation (MYHMC) was formed
in 1972 by the City of New Orleans (“the City’) to operate the Municipal Yacht Harbor in the
manner comparable to that of a private business enterprise; to provide a safe and secure
environment for recreational boating; to ensure that the cost associated with providing services
to the general public are financed or recovered through user fees and charges; and to place an
emphasis on generating a sufficient amount of net operating revenues to be used for maintenance
and capital improvement projects. "
